EXPROPRIATIONS
The Expropriation Act allows an expropriating authority such as a municipality or provincial ministry to take property for a purpose deemed to be in the public interest, even though the owner of the property may not be willing to sell it.
When property is expropriated, the owner is entitled to compensation, taking into account a number of factors:
-
Market Value of the land
-
Damages attributed to the disturbance
-
Damages for injurious affection
-
Any special difficulties in relocation
You have the right to challenge the amount of compensation you are offered, even if you have already accepted the money. However, in some cases you have only one year to make a claim for compensation. The Expropriation Act entitles expropriated owners to recover their reasonable legal costs to ensure that those affected by expropriation have access to justice with the support of professional advice and assistance.
